San Diego Superior Court Civil Mediation Program

INITIAL TWO HOUR SESSION:


The Mediator will be compensated directly by the parties and not by the Court. The fees and expenses of the Mediator must be shared equally between the parties, unless otherwise agreed. For the first two (2) hours of the mediation session (and supplemental mediation discussions between the Mediator and one or more of the parties if within the initial two hours of time), the Mediator’s hourly rate is $150.00 per hour. No other charges are applicable to the first two (2) hours of the mediation session. For any Mediator time in excess of two (2) hours, the hourly rate and other applicable charges will be as set forth below. There is a minimum nonrefundable charge of $300.00 for all services rendered in the first two (2) hours.

BASIC RATES AND CHARGES:


For all time exceeding the initial two (2) hours, the Mediator’s hourly rate is $450.00 per hour. Time is billed in increments of one (1) hour and not fractions thereof. Fees and costs are the responsibility of both the responsible law firm and their client(s) or the party in pro per.

RESERVATIONS AND DEPOSIT:


There is a minimum initial deposit of $750.00 or the amount equal to the applicable charges for the number of hours reserved for the mediation session, whichever sum is greater. The deposit will be allocated equally among the parties, unless otherwise agreed, and invoiced directly to the responsible law firm or party in pro per. Any amount of the deposit paid to reserve time beyond the initial two hours will be refunded to the parties if the additional reserved time is not used. In order to reserve the time and date for your mediation, Glass Mediations must receive the initial deposit within the time period as set forth on your Deposit Invoice. When the full deposit is received in a timely manner, the session is deemed confirmed. In the event all parties have not paid their pro rata share of the deposit in a timely manner, the scheduled mediation session may be vacated and offered to parties in other cases we are currently scheduling.

CANCELLATION AND POSTPONEMENT:


Due to the volume of cases we handle, we must impose a cancellation or postponement charge of $300.00 if you cancel, postpone or reschedule your mediation less than ten (10) business days before the scheduled mediation session. In the event Glass Mediations schedules another matter for the vacated session date and reserved time, the cancellation or postponement charge will be waived. An additional deposit will be required, as set forth above, in order to confirm any rescheduled mediation session.

BALANCES DUE AND CREDITS:


In the event the total fees and costs charged by Glass Mediations exceeds the initial deposit, a final balance due will be allocated equally among the parties, unless otherwise agreed, and invoiced directly to the responsible law firm or party in pro per. Final payment shall be due upon receipt of the invoice. Subject to the two (2) hour minimum nonrefundable charge set forth above, in the event the total fees and costs charged by Glass Mediations is less than the initial deposit, any credit balance due and owing will be refunded directly to the responsible law firm or party in pro per.
